Classifications of Felonies and Misdemeanors In SC

In SC, any crime punishable by three years or less is classified as a misdemeanor, and any crime punishable by more than three years is a felony. Note that this is dramatically different from federal classification of crimes, where any crime punishable by up to one year is a misdemeanor and any crime punishable by more than one year is a felony.

SC Code Ann. § 16-1-20 (1976) outlines the penalties for the different classes of misdemeanors and felonies.

Felonies

  • for a Class A felony, not more than thirty years;
  • for a Class B felony, not more than twenty-five years;
  • for a Class C felony, not more than twenty years;
  • for a Class D felony, not more than fifteen years;
  • for a Class E felony, not more than ten years;
  • for a Class F felony, not more than five years.

Misdemeanors

  • For a Class A misdemeanor, not more than three years;
  • For a Class B misdemeanor, not more than two years;
  • For a Class C misdemeanor, not more than one year.

Exempt Offenses

SC Code Ann. § 16-1-10(D) provides certain offenses that are exempt from the classification system. The following offenses are exempt from classification.
